User Terms and Agreement

Welcome to NFO IQ (the “App”).

NFO IQ is owned by NfoSmart, Inc. This Agreement is between you and NfoSmart, Inc. also referred to as NfoSmart.

By downloading, installing, or using the App, you agree to these terms and conditions (“Terms”) . Please read them carefully before using the App.

Acceptance of Terms

By using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the App.

Description of the App

The App provides a safer, faster, and better QR code experience. The app helps to keep users from being scammed.

The app allows users to view URL endpoint locations, get a Scan Notice of potentially unsafe URLs, block unsafe URLs, view their scan history, and enable auto scan based on the user’s trusted list of URLs.

The app provides a Scan Notice that displays a Red, Yellow, Green or Dark Gray shield. Much like a traffic light, a Red indicates that the user should stop and verify before moving ahead. If NFO IQ does not have data or adequate data about the URL to render a yellow or green shield, the app will render a Red Shield.

This is a proactive and necessary feature in the app to alert a user of a possible scam. In the event a scammer attempts to use a QR code to scam an unexpected user, upon scanning the QR Code, the red shield would display to draw attention and cause the user to look closer at the scanned URL; and therefore, making it harder for a scammer to elude the unexpecting user. Yellow indicates that there is no apparent concern, but precaution is advised. Dark gray indicates that the URL has been blocked.

User Accounts

To use the App, you will need to create an account.

You can select either the Annual subscription or 7-day subscription.

You are responsible for maintaining the confidentiality of your account information, including your password.

You agree to provide accurate and complete information when creating an account and to update your information as necessary.

Subscription

You can select “Subscribe for $2.95/year”. The Annual Subscription is billed upfront and automatically renewed at $2.95 per year. You can discontinue the annual billing at any time by going to the Account section of the app and selecting Manage Subscription. Within Manage Subscription you cancel the annual billing.

You also have the option to select “Start with a 7-day free trial”. This will allow you to start and experience the app for 7 days. If you do not cancel within 7 days, the app will automatically bill your account for the $2.95 annual fee.

No Refund Policy

NfoSmart will work hard to provide you with the best services. However, if you need to terminate or deactivate your account before the expiration of the annual period, NfoSmart will not be able to provide a refund for any portion of the $2.95 billed and paid, regardless of the reason for the termination or deactivation.

Privacy

Your use of the App is also governed by our Privacy Policy, which can be found below via this link.

User Responsibilities

You agree not to use the App for any unlawful or prohibited activities.

You must not interfere with the proper functioning of the App or its infrastructure.

You are responsible for ensuring that your use of the App complies with all applicable laws and regulations.

Intellectual Property

The App and its original content, designs, features, methods, processes, and functionalities are and will remain the exclusive property of NfoSmart.

You agree not to copy, modify, distribute, sell, or lease any part of the App, inclusive of its content, designs, functionality, methods or processes.

Termination

We may terminate or suspend your account and access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease.

Deactivation

You can deactivate your account at any time. If you choose to deactivate your account, all personal identifiers information will be deleted from the account. Therefore, you will not be able to reactivate your account. If you have not breached these Terms, you would be able to create a new account, at any time, after a deactivation.

Limitation of Liability

To the maximum extent permitted by law, NfoSmart shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the App; and/or (vi) the defamatory, offensive, or illegal conduct of any third party. In no event shall NfoSmart’s aggregate liability for all claims related to the App exceed the amount paid by you, if any, for accessing or using the App.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Georgia located in the country of USA, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. In the event of a material change, the Last Updated date will be provided.

Account Protection: Passwords are stored securely using encrypted methods. In addition, we utilize OTP (One-Time Password) as a security measure where the OTP is sent to an email for verification, such as for sign-up.

Data Breach Notification: In the event of a data breach, we have a plan in place to promptly notify affected users and take appropriate action to mitigate the impact.

User-Controlled Data Deletion: You have the right to delete your personal data at any time. The deletion of your personal identifiable information is automatically deleted upon your deactivation of your account. We will permanently delete your personal personal identifiable information from our systems, including backups.

App Store Compliance: We follow all relevant app store guidelines to ensure your data is handled securely and in compliance with platform-specific requirements.

However, please note that no method of transmission over the internet or method of electronic storage is completely secure.

Correct Your Information: Request that we correct any inaccuracies in your personal information when the option is not available for you to make the required corrections via the app.

Delete Your Information: Request that we delete your personal information under certain circumstances.

Children's Privacy

Children under thirteen, are not recommended to scan QR codes, unless under direct adult supervision.
